Definitions and General Provisions

This Online Store Regulations (“Regulations”) define the rules for making purchases within the online store available at the domain lalluchic.com (“lalluchic.com”) and providing electronic services.

The seller is Hanna Bulczyńska, conducting sole proprietorship registered in the Central Register and Information on Economic Activity under the name LALLU CHIC HANNA BULCZYŃSKA, operating at ul. Konopacka 16, loc. 3, 03-428, Warsaw, NIP 9291592345, REGON 385696428, email address: info@lalluchic.com, phone +48 505 097 057.

To make a purchase in the Online Store, it is necessary to meet the following technical requirements: access to the Internet, use of a computer or mobile devices, and the following web browsers: Microsoft Edge, Firefox, Chrome, Opera, Safari – in their latest versions. The Seller notes that using the functionality of the lalluchic.com Online Store, including registration and placing orders for Products, Gift Cards, Individual Order/Consultation, requires having an active email account.

The terms used in the Regulations are defined as follows:

  • Website – means the website available at www.lalluchic.com and its subpages, administered by Lallu Chic Hanna Bulczyńska.
  • Online Store – online store available at the lalluchic.com domain.
  • Seller – Hanna Bulczyńska conducting sole proprietorship registered in the Central Register and Information on Economic Activity under the name LALLU CHIC HANNA BULCZYŃSKA, operating at ul. Konopacka 16, 03-428, Warsaw, NIP 9291592345, REGON 385696428.
  • Buyer – a consumer or entrepreneur with full legal capacity using the Online Store to purchase Products.
  • Product/s – goods/service available in the lalluchic.com Online Store.
  • Consumer – a natural person entering into an agreement with the Seller not directly related to their business or professional activity.
  • Entrepreneur – a natural person, legal person, and an organizational unit without legal personality, conducting business or professional activity on their own behalf.
  • Regulations – these Regulations.
  • Order – the Buyer’s declaration of intent leading to the conclusion of a sales contract with the Seller, specifying, among other things, the quantity and type of the ordered Product. Based on it, the Seller delivers the Products or performs the service.
  • Individual Order and/or Individual Consultation – an order executed by the Seller based on the Buyer’s specification to satisfy their individualized needs. The agreement is concluded by email or during an individual consultation.

Detailed Rules for Sales in the Online Store

Ordering takes place through the Online Store available at lalluchic.com.

Each Product available in the Online Store is a unique item, available in a quantity of one piece only and has its own SKU identifier used for communication with the Seller.

By ordering a Product, the Buyer selects the item from the Products available in the Online Store and places an order.

After selecting the Product by the Buyer, it should be added to the cart by clicking the “Add to Cart” button. The Product is then moved to the cart, which is visible in the upper right corner of the page.

It is possible to place an order for a larger quantity of Products. To do this, follow the instructions in points 1-4.

After going to the cart, a summary of the selected Products is visible, including type, quantity, and price.

Removal of goods from the cart is done by clicking the “x” next to the selected Product.

To process the order, it is necessary to choose the “Proceed to payment” option.

A subpage is activated with the possibility to enter the Buyer’s data and the delivery method, necessary to complete the transaction and send the ordered goods in the order form provided on the Website.

By placing an order, the Buyer declares that all data in the form is true, and the Seller is not obliged to verify their truthfulness and correctness.

The Buyer is responsible for providing false personal data. The Seller reserves the right to suspend the order if the Buyer has provided false data or if these data raise reasonable doubts about their correctness.

After entering all necessary data and choosing the delivery method, on the right side, the total order amount is visible. Clicking the “buy and pay” button confirms the order and transfers the Buyer to the choice of the payment method.

The Buyer can choose from currently available payment methods. In the case of purchases in the Online Store, the Seller does not provide the option of payment on delivery. Payment on delivery is possible only in the case of choosing delivery to the Lallu Chic Atelier in Warsaw.

Payment is made using subcontractors and online payment providers cooperating with the Seller.

The order is considered effective when the Buyer receives an email confirmation from the Seller, sent to the email address provided during registration, which contains the confirmation of all essential elements of the order.

The order processing time is 5 business days, counted from the day following the effective date of the order.

The Seller reserves the right to suspend the order processing time if the Buyer has chosen the Individual Order and/or Individual Consultation option, and the time for order execution is agreed individually.

The order processing time does not include the delivery time, which depends on the chosen delivery method.

If the ordered goods cannot be delivered within the specified time, the Seller informs the Buyer about this fact, allowing them to decide on further action, taking into account the proposed delivery date.

The Seller reserves the right to refuse to process an order if the Products are not available. In such a situation, the Buyer is informed about this fact, and the order is canceled. In the event of a prepayment, the Seller refunds the payment to the Buyer’s account within 14 days from the date of the order cancellation.

The prices of Products in the Online Store are given in Polish zlotys and include all components, including taxes and duties. The total order amount includes the price of the Products and the cost of delivery.

The Seller reserves the right to change the prices of Products in the Online Store, introduce new Products, conduct and cancel promotional campaigns on the Online Store’s website, or make changes to them.

Promotional campaigns in the Online Store cannot be combined unless the regulations of the promotion provide otherwise.

The Seller reserves the right to introduce changes to the Online Store, including changes to the offer, prices, visualizations, descriptions, and technical parameters of Products.

The Seller reserves the right to withdraw individual Products from the offer, introduce modifications to the offer, and carry out and cancel promotional campaigns on the Online Store’s website.

The Seller reserves the right to limit the number of Products available in the Online Store. Information about the limitation of the number of Products available is provided on the Online Store’s website.

In case of withdrawal from the agreement by the Buyer, the Seller may withhold the reimbursement of the payment received from the Buyer until the Seller receives the returned Product or the Buyer provides proof of its return, depending on which event occurs first.

Delivery

The Seller delivers goods to the Buyer through a courier company or postal operator.

The delivery cost is specified during the ordering process and depends on the chosen delivery method.

The delivery time depends on the chosen delivery method and may vary.

The Seller is not responsible for any delays in the delivery of goods caused by the courier company or postal operator.

The Seller may offer the option of personal collection by the Buyer in the Lallu Chic Atelier in Warsaw.

The Seller is not responsible for any damage to the goods during transport if the Buyer chooses personal collection or delivery by a courier company or postal operator not indicated by the Seller.

Complaints and Returns

The Seller is responsible for the conformity of the Products with the agreement. The Seller is liable to the Buyer if the Product has a physical or legal defect.

A physical defect occurs when the Product delivered to the Buyer does not meet the specifications specified in the agreement.

The Seller is released from liability under the warranty if the Buyer was aware of the defect at the time the agreement was concluded.

If a physical defect is found, the Buyer has the right to submit a complaint. The complaint should be submitted to the Seller within 14 days from the date of finding the defect.

The Buyer may submit a complaint in writing to the Seller’s address or by email to info@lalluchic.com.

The complaint should include a description of the defect and the Buyer’s request.

The Seller considers the complaint within 14 days from the date of its receipt.

The Seller may ask the Buyer to deliver the defective Product for examination at the Seller’s expense.

If the complaint is accepted, the Seller will repair or replace the defective Product with a new, defect-free Product. If this is not possible, the Seller will refund the Buyer the amount equivalent to the price of the defective Product.

The Seller is not responsible for defects resulting from the Buyer’s fault, improper use, or storage of the Product.

The Buyer has the right to withdraw from the agreement within 14 days from the date of receiving the Product without giving any reason.

To exercise the right of withdrawal, the Buyer must inform the Seller of their decision to withdraw from the agreement by an unequivocal statement, for example, by mail or email.

The Buyer may use the withdrawal form template attached to the Regulations, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for the Buyer to send the information concerning the exercise of the right of withdrawal before the withdrawal period has expired.

In the event of withdrawal, the Seller reimburses all payments received from the Buyer, including the costs of delivery (except for additional costs resulting from the Buyer’s choice of a delivery method other than the cheapest standard delivery method offered by the Seller), immediately and in any case not later than 14 days from the day on which the Seller is informed of the Buyer’s decision to withdraw from the agreement.

The Seller may withhold the reimbursement until receiving the returned Product or until the Buyer provides proof of having sent back the Product, whichever occurs first.

The Buyer should return the Product to the Seller’s address without undue delay, and in any case, not later than 14 days from the day on which the Buyer informed the Seller of their withdrawal from the agreement.

The Buyer bears the direct cost of returning the Product.

The Buyer is liable for any diminished value of the Product resulting from handling it other than what is necessary to establish the nature, characteristics, and functioning of the Product.

The Seller may refuse to reimburse the payment until receiving the Product back or until the Buyer provides proof of having sent back the Product, whichever occurs first.
